El argumento central es que a lo largo de los dos periodos presidenciales la dinámica de las relaciones entre ambos poderes fue de confrontación del Ejecutivo con las Cortes. Los enfrentamientos se produjeron por la renuencia del Presidente y, con él, de la mayoría de los miembros de la coalición de gobierno, a aceptar controles jurídicos y limitaciones al ejercicio del poder político. Esto ocurría debido a la concepción del poder político y de la democracia que inspira a Uribe Vélez, quien soslaya el Estado de derecho como pilar fundamental de la democracia y favorece la validación plebiscitaria de la misma, concepción propia del monismo constitucional.Palabras Clave: Altas Cortes, Álvaro Uribe Vélez, Poder Ejecutivo, Poder Legislativo, Estado, Colombia. ABSTRACTThe courts confrontation: Tensions between the Executive and the High Courts in Colombia 2002-2010The article analyzes the relationship between the executive and the high courts in Colombia during the governments of Álvaro Uribe Vélez (2002-2006 and 2006-2010). The central argument is that over the two terms the dynamics of relations between the two powers has been confrontational Executive of the Courts, which has led to a renewed attempt to challenge and control of the President on highest courts. Confrontations have been generated by the reluctance of the President, and with it most of the members of the coalition government, to accept legal controls.
